| We Respect Your Privacy We understand there is certain information you don’t want to share with everyone. And we are just as concerned about safeguarding the information you provide to us. That is why we have adopted this Privacy Policy. We value the trust you have placed in us and are committed to earning and maintaining your confidence. This Privacy Policy is provided to you by each of the companies within the IndyMac family that are listed at the end of this Privacy Policy. For convenience, these companies are referred to as “IndyMac,” “we,” “us,” “our,” or “ours.” The words “you,” “your,” or “yours” refer to each individual who is one of our customers or former customers and other individuals who obtain or request a financial product or service from us. Introduction This Privacy Policy describes the kinds of information we collect, how we use that information and the limited circumstances under which we will share it. Information Collection We will collect information about you that we reasonably believe will be necessary or useful in processing or administering products or services that you have requested from us. We will also collect information in order to notify you about products, services and other opportunities we think will be of interest to you. This information may be collected from a variety of sources, such as the following: (1) information provided by you in applications or other forms, or in connection with obtaining financial products and services such as mortgage loans, deposit accounts, and investment products and services, (2) information obtained from a consumer reporting agency, and (3) information about your transactions with us, our affiliates or others. Maintenance of Accurate Information We work hard to ensure your information is as accurate, current and complete as possible. If you ever find that our records are inaccurate or not current, please contact us at the telephone number on your account statement. If the record is within our control, we will correct any inaccurate or incomplete information. Security Procedures to Protect Customer Information Access to our systems containing nonpublic personal information is only provided to those employees and agents whom we determine need it for the purpose of providing products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information. Information Sharing Within Our Affiliated Family of Companies There are times when we will share a portion of your nonpublic personal information with our affiliated companies that either currently exist or that we may create or acquire in the future. However, we will only do so in order to provide you with superior service, inform you of product and service opportunities that may be of interest to you, improve and develop our products and services, or perform other business functions. An “affiliated company” or “affiliate” is any member of our family of companies or any company that we own or control. Affiliated companies may be any of the following: · Financial services providers, such as consumer lending and mortgage banking companies, life and casualty insurance companies, insurance agencies, securities brokerage firms, trust companies, and companies that provide settlement services, such as title agencies, escrow companies, and appraisal firms; and · Others, such as non-profit organizations. The types of information we may share with our affiliates include (i) identifying information, such as your name, address and social security number (we call this “Identifying Information”), (ii) information about our experiences and transactions with you, such as your deposit balance, investment history, loan balance and/or payment history (we call this “Experience Information”), and (iii) information about you or the products or services you obtain from us other than Identifying Information or Experience Information, such as information we receive from your applications and information from consumer reporting agencies (we call this “Other Information”). You are given the choice of restricting our sharing of certain information about you with our affiliates by calling the toll free number listed below or by sending your instructions to us at the address provided below. Information Sharing with Unaffiliated Third Parties Unlike some other financial institutions, we do not sell customer lists or other information about our customers to unaffiliated third parties. We may share nonpublic personal information about you with unaffiliated third parties as described below. We may also disclose nonpublic personal information about you as permitted by law. In order to efficiently and cost-effectively market our own products, we contract with companies providing marketing and solicitation services, such as printers, marketing fulfillment firms and other companies. As part of these activities, we may provide limited information about our customers to such parties. In addition, we may engage in joint marketing with unaffiliated financial institutions for various financial products and services (such as credit life and disability insurance) that we do not offer on our own, but we think will be of interest to our customers. In such cases, IndyMac will always be identified in the joint marketing materials or solicitation. We may disclose all of the information we collect (described in “Information Collection” above) to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements. Our agreements with these companies are subject to confidentiality provisions and restrictions that prohibit using the information beyond the performance of the specified services or in connection with the jointly marketed product or service. California residents will be given the choice of restricting our sharing of certain information with unaffiliated financial institutions for joint marketing purposes by calling the toll free number listed below or by sending instructions to us at the address provided below. Our Former Customers Rest assured that even if you are no longer a customer of IndyMac, we will continue to treat the information we have with the same level of confidentiality. We appreciate your business and want you to understand our commitment to maintaining the privacy of your personal information, as expressed in this Privacy Policy. This Privacy Policy applies to individual consumers. We reserve the right to amend this Privacy Policy at any time. Important Privacy Choices for Consumers You have the right to control whether we share some of your personal information. You also have the right to control how that information is used. Please read the following information carefully. Your Rights You have the following rights to restrict the sharing of personal and financial information with our affiliates and outside companies that we do business with. You also have the right to limit our affiliates from marketing their products and services to you based on information that we share with them. Nothing prohibits the sharing of information necessary for us to follow the law, as permitted by law, or to give you the best service on your accounts with us. This includes sending you information about some other products or services. Your Choices Restrict Information Sharing With Companies We Own or Control (Affiliates): Unless you say “No,” we may share personal and financial information about you with our affiliated companies. If you are a California resident, your choice will apply to all information. If you are not a California resident, your choice will apply only to Other Information. For all customers, your choice will limit our affiliates from using any of your personal or financial information to market their products or services to you. If you have a joint account, any party on the account can make this choice. That choice will apply to all parties on the account. OPTION 1: NO, please do not share personal and financial information with your affiliated companies. Also, I do not want your affiliates to market their products or services to me based on information that you share with them. Restrict Information Sharing With Other Companies We Do Business With To Provide Financial Products And Services: Unless you say “No,” we may share personal and financial information about you with outside companies we contract with to provide financial products and services to you. Only California residents may make this choice. A choice by someone else will have no effect. If you have a joint account, any party on the account can make this choice. That choice will apply to all parties on the account. OPTION 2: NO, please do not share personal and financial information with outside companies you contract with to provide financial products and services. If you wish to direct IndyMac to stop sharing certain nonpublic personal information about you pursuant to one or both options set forth above, please call our Customer Contact Center at 1-877-210-2336 between 8 a.m. 5 p.m., Pacific Time, Monday through Friday, or you may send your instructions to IndyMac, P.O. 7211, Pasadena, CA 91109-7311. When you call or send your instructions to us, please provide the following information: Your Name Full Account or Policy Number(s) (as shown on your statement) Last Four Digits of Your Social Security Number If you have already conveyed your privacy preferences with us, there is no need to do so again. |
